Rep. Darrell Issa (R-Calif.) said the Environmental Protection Agency's lack of response to a request from the House Committee on Oversight and Government Reform "borders on absurd."
According to media reports from Capitol Hill, Issa, along with Rep. Jim Jordan (R-Ohio) said in a letter they want to fully comprehend the intentions behind the EPA's initiation of the Bristol Bay Watershed Assessment. Requests for material detailing that intent have been slow in coming, Issa contends, threatening the EPA with a subpoena if the documents are not produced.
Though the EPA contends that its actions, which were initiated in response to requests from stakeholders in the region, are within its authority of the Clean Water Act Section 104(a), pertaining to research and investigation of possible ways to eliminate pollution.
Issa is not the first to criticize the assessment, which some, including the Pebble Partnership developing the large-scale mine claim in the Bristol Bay watershed area, as well as some of Alaska elected officials, call premature.
Issa reportedly claims that he has made multiple requests from the EPA to provide documents regarding the initiation of the assessment, but hasn't received them. This is not the first time the EPA and Issa have exchanged blows.
Last May, the EPA replied to a letter from Issa in which the representative said the EPA "is considering using an unprecedented and legally questionable interpretation of the CWA to preemptively veto permits for the Pebble Project." EPA's Associate Administrator Arvin Ganesan replied then that the EPA had not initiated a section 404(c) review.
"We are conducting the assessment to inform future decision making," Ganesan wrote.
